We are Jessica Nicolosi Photography (“Company,” “we,” “us,” or “our”), owned and operated by Jessica Nicolosi, located at 181 Altair Drive, Getzville, New York 14068, USA.

These Terms of Use (“Legal Terms”) govern your access to and use of our website, online galleries, social media pages, and any other related services or materials (collectively, the “Services”).

By accessing or using the Services, you agree that you have read, understood, and accept these Legal Terms and our Photography Services Agreement, which together form a binding contract between you and Jessica Nicolosi Photography. If you do not agree, you must discontinue use of the Services immediately.

Our Services

Our Services include photography, image licensing, and delivery of photographic materials, as well as related content (such as portfolios, sample images, and educational materials). Use of these Services is subject to these Terms and all applicable laws. Access from outside the United States is at your own initiative and risk.

Intellectual Property Rights

All photographs, graphics, text, videos, designs, and other creative materials made available through our Services (“Content”) are owned by or licensed to Jessica Nicolosi Photography and protected by U.S. and international copyright, trademark, and intellectual property laws.

Upon final payment for services, clients receive a limited, non-exclusive, non-transferable license to use delivered images for personal or internal promotional use. Commercial, editorial, resale, or third-party use requires separate written permission or licensing.

We retain full copyright and ownership of all images created during any session or event, including raw image files, and reserve the right to use images for portfolio, marketing, educational, or promotional purposes unless otherwise agreed in writing. Clients wishing to opt out must provide written notice at least 72 hours before the session.

User Responsibilities

By using our Services, you represent that you are at least 18 years old, will not misuse content, will provide accurate booking information, and will comply with all applicable laws.

Payment & Booking

Payment terms are governed by your Photography Services Agreement. A non-refundable deposit is required to reserve your session date, and final payment is due before the event or image delivery.

Post Production & Delivery

All editing decisions are at the Photographer’s discretion. Final, edited images represent the completed work. Raw or unedited images are not provided. Delivery typically occurs within 3 weeks for preview galleries and 8–12 weeks for final images.

Storage & Archival

Delivered images are stored for 90 days after delivery. Extended archival storage may be purchased but is not guaranteed beyond that period.

Limitation of Liability

To the fullest extent permitted by law, Jessica Nicolosi Photography shall not be liable for any indirect, incidental, or consequential damages. Total liability shall not exceed the total amount paid by you under your Photography Services Agreement.

Indemnification

You agree to indemnify and hold harmless Jessica Nicolosi Photography and its affiliates, employees, and contractors from any claims, damages, or expenses arising from your use or misuse of the Services, breach of these Terms, or violation of another’s rights.

Cancellation, Postponement, & Force Majeure

Cancellations or reschedules must follow the procedures in your Photography Services Agreement. We are not liable for failure or delay in performance due to circumstances beyond our control, such as illness, weather, or acts of God.

Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of New York. Disputes shall first be resolved through negotiation, then mediation, and if unresolved, through binding arbitration under the rules of the American Arbitration Association (AAA).

Termination

We may suspend or terminate access to the Services at any time for violation of these Terms or applicable laws. Upon termination, all licenses granted automatically end.

Electronic Communications and Signatures

By using our Services or contacting us electronically, you consent to receive communications by email or digital means. You agree that electronic signatures and records satisfy all legal requirements for written agreements.

Miscellaneous

These Terms, together with your Photography Services Agreement, represent the entire understanding between you and Jessica Nicolosi Photography. If any provision is found invalid, the remaining sections remain enforceable.
