I do not directly store full credit or debit card details. Payments are processed securely through trusted third-party processors such as PayPal, Venmo, Zelle, or Pixieset Pay, depending on the method you choose. These platforms process your information according to their own privacy policies.

Images and Related Media

As part of providing photography services, I collect and process photographs, videos, and related metadata. These may include images of individuals, groups, or property. Images are stored securely for the duration outlined in your Photography Services Agreement, a minimum of 90 days after delivery, with optional extended storage available for purchase.

Automatically Collected Information

When you visit my website or online gallery (hosted by Pixieset), certain information may be automatically collected, such as:

  • IP address

  • Browser type

  • Device information

  • Date and time of access

  • Referring website

This data helps maintain website functionality and security and is handled through Pixieset’s systems under their own privacy policy.

How I Use Your Information

I use your personal information only for legitimate business purposes related to photography services, including:

  • Communicating with you about scheduling, contracts, and deliverables

  • Processing payments and invoicing

  • Delivering image galleries and final products

  • Managing client preferences (such as opt-out of promotional use)

  • Maintaining records for legal and tax compliance

  • Protecting against unauthorized use or access

  • Responding to lawful requests or obligations

I do not sell, rent, or trade your personal information to third parties.

Image Usage and Client Consent

As stated in my Photography Services Agreement, I may use images from sessions or events for promotional, portfolio, educational, or grant-related purposes, including social media, website galleries, and printed materials.

Clients, participants, or attendees who do not wish to be photographed or have their image used must notify me in writing at least 72 hours before the session or event. If no written notice is received, participation is considered consent for photography and promotional use.

This opt-out right applies to all services provided by Jessica Nicolosi Photography.

Third-Party Services

To provide a secure and seamless client experience, I use reputable third-party service providers. These may include:

  • Pixieset – for hosting and delivering image galleries

  • PayPal, Venmo, Zelle, or Pixieset Pay – for secure payment processing

  • Email providers (e.g., Gmail) – for communication and document delivery

These third-party services process personal data under their own privacy policies. I do not control and am not responsible for their individual data handling practices.

Data Retention

Personal data (including client information, contracts, and image files) is retained only as long as necessary to fulfill the purposes described in this Policy or as required by law.

  • Delivered images are retained for at least 90 days after delivery.

  • Extended archival storage may be purchased by the client at booking or after delivery.

  • After the retention period, files may be deleted or permanently archived offline in a secure location.

  • Basic business records (e.g., invoices, contracts) are retained for up to seven (7) years as required by tax law.

How I Protect Your Information

I use reasonable administrative, technical, and physical safeguards to protect your personal information from unauthorized access, loss, misuse, or disclosure. While no online system can be guaranteed 100% secure, I take every reasonable precaution consistent with a small professional business, including:

  • Secure, password-protected devices and cloud accounts

  • Encrypted file transfers for gallery delivery

  • Limited access to client files

If a data breach ever occurs, affected clients will be notified as required by law.

Marketing and Communications

I do not send bulk marketing emails or newsletters. I only contact you directly for service-related purposes, such as:

  • Booking confirmations

  • Invoices and payment reminders

  • Session coordination and delivery notifications

  • Follow-up regarding your gallery or purchased products

My website and gallery service (Pixieset) may use cookies or similar technologies to improve user experience, maintain session security, and analyze basic usage data. You can control or delete cookies through your browser settings, though doing so may affect website functionality.

Legal Basis for Processing (for Canadian or International Clients)

If you are located outside the United States, I process your personal information with your consent, to fulfill a contract, or where necessary for legitimate business interests. You may withdraw consent at any time by contacting me, though doing so may limit your ability to receive services.
